These Terms & Conditions (the "Terms") govern your access to and use of the VehicleMatic automotive-data APIs, developer portal, and related services (together, the "Service"). The Service is operated by MATIC AUTOMOTIVE LIMITED, a company registered in England & Wales, whose registered office is at 85 Great Portland Street, First Floor, London, England, W1W 7LT ("VehicleMatic", "we", "us"). By creating an account or making an API request, you agree to these Terms.
1. Definitions
"Account" means your VehicleMatic company account. "Credits" means the prepaid units consumed by billable API lookups. "Data" means the automotive data returned by the Service (including DVLA vehicle registration data, DVSA MOT history, valuation, provenance and driver-licence data). "You" means the company or individual accessing the Service.
2. Eligibility and account
- You must be at least 18 and able to form a binding contract.
- You are responsible for the accuracy of your registration details and for all activity under your Account and API keys.
- You must keep your API keys secret. You are responsible for lookups made with your keys, whether or not authorised, until you revoke them.
3. The Service and API access
We grant you a non-exclusive, non-transferable, revocable licence to access the Service through your API keys, subject to these Terms and any plan limits. We may add, change or deprecate endpoints; we will use reasonable efforts to give notice of breaking changes.
4. Acceptable use
You agree not to, and not to permit any third party to:
- use the Data other than for a lawful purpose for which you have the necessary rights and consents;
- exceed your rate limits, circumvent metering, or share, resell or sublicense your API keys except as expressly permitted;
- use the Service to build a competing bulk database, or to systematically scrape, cache or redistribute the Data beyond what is reasonably required to operate your application;
- use the Data for direct marketing, tracing individuals, or any purpose prohibited by the DVLA, DVSA or applicable law.
5. Credits, billing and payment
- Billable lookups consume Credits. Credits may be purchased as packs or granted as a monthly allowance under a subscription.
- A lookup is charged on successful delivery of Data. Where a result is served from recently retrieved records rather than a fresh source request, we may still charge the applicable Credit cost.
- Credits are non-refundable except where required by law. Subscription allowances expire at the end of each billing period unless stated otherwise.
- Payments are processed by our payment provider (Stripe). You authorise us to charge your chosen payment method for amounts due.
6. Data sources and accuracy
The Data is aggregated from third-party sources including the DVLA, DVSA and licensed data partners. We normalise and relay this Data but do not originate it and cannot guarantee it is complete, current or error-free. The Data is provided for information only and must not be the sole basis for a decision with legal or safety consequences.
7. Intellectual property
We and our licensors retain all rights in the Service, the API, and the compilation and normalisation of the Data. You retain rights in your own applications and data. No rights are granted except as expressly set out in these Terms.
8. Availability and support
We aim to keep the Service available but do not warrant uninterrupted or error-free operation. Planned maintenance and support are provided in line with your plan. We may suspend the Service to protect its security, integrity or availability.
9. Warranties and disclaimers
Except as expressly stated, the Service and Data are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
10. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law. Subject to that, we are not liable for loss of profits, revenue, data or goodwill, or for indirect or consequential loss; and our total liability arising out of or in connection with the Service in any 12-month period is limited to the greater of the fees you paid us in that period or £100.
11. Indemnity
You will indemnify us against claims, losses and costs arising from your use of the Service or Data in breach of these Terms or applicable law.
12. Suspension and termination
You may close your Account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or where required by a data source or by law. On termination, your licence to use the Service and Data ends and you must cease using and delete cached Data save where retention is legally required.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email or in the portal. Continued use after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
